Premature Discharge of Patient Medical Malpractice Claims

Discharging a patient from a hospital before they are ready can cause more damage and create a bigger medical problem than the one for which the patient originally sought treatment. Should a patient be discharged from the hospital with a serious medical condition that has yet to be properly addressed, there will not be doctors and other medical professionals around to immediately respond. The harm a patient can suffer due to premature discharge from the hospital can be severe and lasting. That is why, prior to discharging a patient, doctors need to do things like administer specific tests to ensure the patient is healthy, monitor vital signs to ensure the patient is staple, and check for any underlying conditions that may need immediate treatment. When a doctor fails to do these things and a patient is discharged too early from the hospital which leads to the patient needlessly suffering harm, then the patient may be able to bring a medical malpractice claim. The dedicated medical malpractice attorneys at Fazli & Associates are prepared to step up and fight for these patients who have suffered due to medical negligence. We zealously advocate on behalf of our clients to get them the compensation they deserve for harm they have endured because of medical malpractice.

Common Types of Early Discharge Cases

Cases where a patient is discharged too early from the hospital can be tragic. This is especially true considering one of the most common types of early discharge cases is infant early discharge. There are so many complications that can arise in a baby’s first moments of life. That is why the American Academy of Pediatrics insists that infants remain in the hospital for at least 48 hours after birth. The 48-hour mark is the minimum recommendation, but infants may need to remain in the hospital for longer depending on their health status. When an infant is discharged too early from the hospital, these little beings who are at their most vulnerable and are totally dependent on others can suffer as a result.

It is also common for patients to be discharged too early post-surgery. Prior to discharge, a patient who has just undergone surgery must be checked for things such as post-surgery infection. Depending on the surgery, other tests should be administered to ensure the patient is healthy and stable for discharge. For instance, a patient who has just undergone heart surgery should have his or her pacemaker checked prior to discharge from the hospital.

Premature discharge happens for many different reasons. Often, the hospital faces pressures from overcrowding. Overcrowding can mean the hospital may not have enough beds or enough staff to support patients. It has been found, however, that hospital overcrowding is mostly preventable when the hospital implements proper planning techniques. When a hospital or doctor fails to take due care in preventing patients from being discharged too early, medical malpractice has occurred. When patients suffer due to this, they can seek compensation for their damages through bringing a medical malpractice claim. That is where Fazli & Associates steps in. Our firm is committed to enforcing the legal rights of those injured by medical negligence.

How Do You Prove Medical Malpractice Occurred in a Premature Discharge of Patient Case?

In premature discharge of patient medical malpractice cases, it must be determined whether or not the patient was in fact discharged too early and whether it was due to negligence on the part of the doctor, hospital, or other medical professional. To determine whether negligence occurred, we look to the appropriate standard of care for doctors and other medical professionals. Doctors must act as a similarly skilled, similarly situated doctor would act under similar circumstances. To prove medical negligence, you need to be able to point to where the doctor failed in upholding this standard of care. This means the doctor did something like failed to properly diagnose and treat a condition prior to discharge or failed to ensure a patient was medically stable prior to discharge.

In addition to proving negligence, a plaintiff in a medical malpractice case must also be able to prove that he or she suffered harm as a result of the asserted medical negligence. The harm suffered are referred to as the patient’s “damages.” Damages may include things like:

  • Cost of medical treatment

  • Cost of future medical treatment

  • Loss of earning capacity

  • Lost earnings

  • Loss of enjoyment of life
